1. Acceptance of Terms

Welcome to Dreamstone Monuments. These Terms of Service ("Terms") govern your use of our website and the purchase of our products and services. By accessing our website, requesting a quote, or purchasing our products, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not use our services. We reserve the right to modify these Terms at any time, and continued use of our services following any changes constitutes acceptance of the revised Terms.

2. Services Provided

Dreamstone Monuments specializes in creating custom memorials, monuments, and related products and services, including:

• Custom monument design and fabrication
• Headstones and grave markers
• Custom mausoleums
• Porcelain portraits and photo installation
• Monument additions and accessories
• Engraving and inscription services
• Monument installation and delivery
• Cleaning, restoration, and maintenance services

3. Orders and Quotes

3.1 Quote Process

All quotes provided are estimates based on the information you provide. Final pricing may vary based on actual specifications, materials selected, cemetery requirements, and any additional services requested. Quotes are valid for 90 days from the date of issue unless otherwise specified.

3.2 Order Confirmation

An order is considered confirmed once we have received your signed approval of the design proof and your deposit payment. We will provide you with a written confirmation including project timeline, specifications, and payment schedule.

3.3 Custom Orders

All monument orders are custom-made to your specifications. Once production has begun, orders cannot be cancelled, and deposits are non-refundable. We will work with you through the design approval process to ensure complete satisfaction before beginning fabrication.

4. Pricing and Payment

4.1 Payment Terms

Standard payment terms require:

• 50% deposit upon order confirmation
• 50% balance due before delivery or installation

Alternative payment arrangements may be available upon request and approval. All prices are in US Dollars unless otherwise specified.

4.2 Accepted Payment Methods

We accept payment by cash, check, credit card, and bank transfer. A processing fee may apply to certain payment methods.

4.3 Late Payments

Late payment fees may be assessed on outstanding balances. We reserve the right to withhold delivery or installation until full payment is received.

5. Design Approval and Proofs

Before production begins, we will provide you with a detailed design proof for your approval. This proof will include layout, dimensions, text, and any artwork or emblems. You are responsible for carefully reviewing and approving all details.

Once you approve the design proof in writing, we will proceed with fabrication. We are not responsible for errors that were present in the approved proof. Additional charges may apply for changes requested after approval.

6. Production and Delivery Timeline

6.1 Production Time

Standard production time is typically 6-12 weeks from design approval, depending on the complexity of the design and current workload. We will provide an estimated completion date at the time of order confirmation.

6.2 Delays

While we strive to meet all estimated timelines, production and installation may be delayed due to weather conditions, cemetery restrictions, material availability, or other circumstances beyond our control. We are not liable for damages resulting from delays.

6.3 Installation

Installation scheduling is subject to cemetery regulations, weather conditions, and ground conditions. We will coordinate with you and the cemetery to schedule installation at the earliest appropriate time.

7. Cemetery Regulations

You are responsible for ensuring that your monument complies with all cemetery rules and regulations. While we will make reasonable efforts to assist with cemetery requirements, we are not responsible for cemetery restrictions or additional fees imposed by the cemetery.

Cemetery foundation requirements, installation fees, and perpetual care fees are not included in our pricing unless specifically stated. You must obtain all necessary approvals from the cemetery before we can proceed with installation.

8. Warranty and Quality Guarantee

8.1 Materials and Workmanship

We guarantee that all monuments are crafted from high-quality granite and are free from defects in materials and workmanship. Our warranty covers:

• Structural integrity of the monument
• Quality of engraving and lettering
• Proper installation and setting

8.2 Natural Stone Characteristics

Granite is a natural stone and may contain natural variations in color, veining, and texture. These natural characteristics are not defects and add to the unique beauty of each monument. We do not warrant against natural variations inherent in stone.

8.3 Warranty Limitations

Our warranty does not cover:

• Damage from vandalism, accidents, or acts of nature
• Normal weathering and patina development
• Settling or shifting due to ground movement
• Damage caused by improper maintenance or cleaning
• Third-party modifications or additions

9. Cancellations and Refunds

9.1 Before Production

Orders may be cancelled before production begins with a written notice. A cancellation fee of 25% of the total order value will be assessed to cover design time and administrative costs.

9.2 After Production Begins

Once production has begun, orders cannot be cancelled. Deposits and payments made are non-refundable. All custom-made monuments are final sale.

9.3 Defective Products

If a monument is found to be defective due to our error or material defect, we will repair or replace it at no additional cost. This is your exclusive remedy for defective products.

10. Limitation of Liability

To the fullest extent permitted by law, Dreamstone Monuments shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services or products. Our total liability shall not exceed the amount paid for the specific product or service giving rise to the claim.

We are not responsible for:

• Cemetery fees, regulations, or restrictions
• Delays caused by weather, natural disasters, or other events beyond our control
• Errors in information provided by the customer
• Damage occurring after installation is complete

11. Intellectual Property

All custom designs, artwork, and materials created by Dreamstone Monuments remain our intellectual property unless otherwise agreed in writing. You may not reproduce, distribute, or use our designs for any purpose other than the specific monument for which they were created.

Any artwork, photographs, or designs you provide remain your property. By providing them to us, you grant us permission to use them solely for the purpose of creating your monument.

12. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy. By using our services, you also agree to the terms of our Privacy Policy.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.

Any disputes arising from these Terms or our services shall be resolved through good faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Robeson County, North Carolina, in accordance with the rules of the American Arbitration Association.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
